Bashin v. Conduent, Inc.

This is a qui tam action against Conduent Incorporated, Conduent State & Local Solutions, Inc. , and US eDirect, Inc. to recover damages, civil penalties, and attorneys’ fees and costs on behalf of California for the Defendants’ violation of the California False Claims Act, Government Code sections 12651(a)(1), (a)(2), and (a)(8), in connection with a contract with the State of California Department of Parks and Recreation for a new “Recreation and Reservation Sales Service,” launched as ReserveCalifornia.com, the public-facing website that is the primary means by which visitors book campgrounds and lodging in California state parks.

In spite of contractual requirements, the delivered website—on its “go-live” date of August 1, 2017 and up to at least March 31, 2021—has been inaccessible to blind users like Mr. Bashin, and to people with limited vision or manual dexterity. As a result, Mr. Bashin and other similarly situated people with such disabilities—likely numbering tens of thousands—have been deprived of the ability to equally use the website to secure reservations in California’s most popular parks and relegated to partial and inferior access to the benefits of state parks.
